Yes, you need to be an attorney to represent persons before bankruptcy court. These practitioners are typically specialists in this field because it is a highly regulated area of law (and all federal law).
Be careful of different companies that hold themselves out to be document preparers or the like. A lot of non-lawyers will tell you they are only in the business of helping you fill out forms to do your own legal affairs.
Some of these practitioners are legit, but many come real close to the illegal practice of law without a license. When they start out anything with "look, don't take this as me giving you legal advice, but...." that's where you start having problems. Use an attorney...do it right. My husband and I have filed for ch. 13 bankruptcy in Texas. The attorney that he selected tends to range from nice to rude, especially when we don't understand an issue. He tends to be a bit pompous when he responds to us. He missed one major creditor that had to be added in as an amendment (property taxes) and failed to calculate the correct amount of monies paid to creditors in the past 90 days. He saw the property tax statement and gave it back to me, and we didn't add it in the worksheet. I gave him a list of creditors and amounts that we had paid in that time frame, but he only filed our statement of income showing one payment per creditor. Our meeting of creditors is in 20 days. I have considered firing him and getting another attorney. Can I get a refund on his fees from him? Is it possible to have another attorney review our bankruptcy paperwork (second opinion) before being finalized to make sure everything is correct before we find another mistake or the court finds one? A: You could get a second opinion. You could fire your attorney. You could ask the court to review your lawyer's fees under section 329 of the Bankruptcy Code. You'd probably have to pay another lawyer something to take the time to review your first attorney's file. You could discuss this with the local bar association or the state bar. You may have specialists in Bankruptcy in Texas. Have you considered looking for a certified specialist in the field?
You may simply have difficulties in communication with your attorney. Why not express your concerns to him in the first place and see if you can work things out. If not, consider some of the alternatives mentioned above.

I paid my retainer fee for a bankruptcy attorney. I am hesitant to inform my creditors of this move for fear they will rush to sue me before my claim is in the courts. But I want the calls to stop. Any advice or experience?
A: If you have paid the retainer in full, the creditors have to cease and desist any collection attempts against you. No, they cannot sue you at this point, if they even tried they could be fined up to 1,000.00 for attempting as you are protected now under the bankruptcy laws. Your attorney on request from you or their assitant in the office can fax over a copy of your case filing to the creditors. If you have a case#, answer the phone, tell them you filed bankruptcy, they will ask you for the case # , give it to them, legally, they cannot contact you after that. The US Bankruptcy court, once they receive your case, will notify each creditor and it usually takes approx 30 days for them to get the notification. Q: Can a collection agency call after you have given them your bankruptcy attorney's number?
I received a phone call from a collection agency about a month ago, Tibouron Financial to be exact. I told them very nicely that I had retained a bankruptcy attorney and gave them his name and number. They have called me twice today, and everytime they have called, I would answer the phone on the second ring and there would be a dial tone. Also I should add that this was 7:30 at night. What should I do?
A: Often you'll find that collection agencies have automated diallers, they dial numbers from a list and when you answer a call center agent is connected to your call, it doesn't connect an agent until the call is answered and saves time from the staff dialing busy numbers etc. What will sometimes happen is that if all the agents are busy, when you answer there will be nobody available so it'll dump the call.
Just ignore the calls, or give your attorney the information. You could also call your phone company and have a bar put on the number.

They gave me good real answers as to whether I would qualify for a bankruptcy. Lexington Law Group has an office in Beverly Hills, but its worth the drive. I know you are in Northridge, but in Los Angeles you just hop onto the freeway and you can hop onto the 405 freeway and you'll get to Beverly Hills, Santa Monica or wherever in 15 minutes. I personally live in Woodland Hills and it was quick.
As for fees they are pretty reasonable. I remember them saying that they charge mostly based on the persons situation. So if your situation is easy it should be cheap. I paid $2k and had only 30k in debt that they wiped out. A: The other answers are great....basically the attorney is making sure your interest is protected, your paperwork is filled out correctly and filed on time, and to represent you in court.
But from my observations, their main concern is to make sure they get paid. I've seen a lot of bankruptcies get messed up by poorly trained lawyers.
To find a good one, check with the local bar.....but also try asking the local BK trustees. They work closely with these attorneys and know who the slackers are.

Make sure that the bankruptcy attorney devotes a significant portion of their practice to consumer bankruptcy - there are attorneys out there who do various other things, like PI, divorce, etc and don't devote sufficient time to bankruptcy work.
